A UNIQUE CASE OF HERITAGE PROTECTION VS EDUCATIONAL DEVELOPMENT

When the educational expansion got trapped into the nexus of legal hurdles.

Two most reputed colleges in University of Delhi exclusively for women – GARGI COLLEGE and KAMALA NEHRU college are still dreaming of constructing in premise hostel and other facilities to match the pace of other fast developing colleges under University of Delhi.

As the “SIRI FORT”( An Archaeological survey of India protected monument)  walls  share their boundaries with these colleges ,it has become practically impossible for them to carry out any construction because of Laws on Conservation and protection of Heritage monuments (1904 and 1915) which states that – no buildings can be constructed near the monuments which exceeds more than its original height. Being one of the most deemed college Gargi  still has no separate girls hostel.

The conundrum faced by the Kamala Nehru college is even worse, how would you feel if you are thirsty and somehow manage to get a glass of water but still can’t have it? Same is the problem with the Kamala Nehru College being entangled in the legal complexities it cannot utilize the funds provided to it under the name of OBC expansion 2013. When finally after the tiring “legal battle” it received the NOC( no objection certificate) it again got trapped in the vicious circle as its funds got expired and had to be returned to UGC (University grant commission).

According to sources both the colleges have enough space to construct the building  but are unable to do so and the students are only at loss. The colleges also have proposed the idea of building a joint hostel but that too failed due to the glich in our judicial system . The institutions are still unsure that how are they going to expand.
